    see my signature, no receipts till date money order not cashed, Called USCIS got an answer.... "Not yet in the System", but IO told me there is a big junk of files and it will be processed in next 30 or 40 days.

    All the desi employers I ran into or my friends ran into turned out to be blood suckers. before that I was employed by an american company for 6 years and I had no complaint whatsoever.

    I think most of us desis consider other desis to be inferior and treat them so.


    Atleast your DESI employers start GC early maybe after 6 months. Most american employers dont even start GC until you are in 5th year of H1. Employers are employers, they dont come with nationalities on their forehead. There are so many american companies who have filed bankruptcy when a large payment was pending and your desi employer attempted to recover it.

    My order so far is follows

    Aug 12 8AM - Email -> Notice mailed welcoming the new permanent resident.
    Aug 12 9PM - Email -> Card production ordered.
    Aug 15 - Email -> Approval notice sent (for ME)
    Aug 18 - Email -> Approval notice sent for Spouse
    Aug 18 - Received I-797C Approval Notice for both me and spouse by USPS. In fact i received 3 original copies of the same approval for me and only 1 for my spouse.

    Still waiting for the actual cards to come.

    I am exactly in the same situation...Did you receive them by now?

    My Details:

    On 8/12/08, I saw the message "Approval Notice Sent" on USCS site for me and my wife. There was no sequence for us like Welcome Notice...Card Production ordered...Approval Notice....The first and only message was Approval notice sent.

    So,

    On 08/18/08 myself and my wife received the mail(post) of approval notice but we did not get the cards. Generally till now what I heard and saw in forums is....when we see the message "Approval notice sent" in the USCIS site, every body got their cards in a week after that message.

    But for us we got only notices saying that it is approved and the message on the Notice says

    "The above application has been approved. Prior to receiving your permanent resident card you may be required to report for biometrics processing (photo/fingerprint/signature). Please do not take any action at this time. If you are required to report for this processing, you will receive another notice advising you of the date time and location to appear.

    If you have not received your permanent resident card or the above mentioned notice to appear for biometrics processing within 90 days, please call this office at the number listed below"

    Please do let me know if any body in the same situation and do we need to do any thing for it.

    Good/Bad watever kind of lawyers i deploy they will be costly - but can they win such cases - Do you know of ??

    You can quit after six months and then if taken to a court of law, you can tell the court that the employer refused to give you employment letter and under duress, you were forced to sign the letter. Your other option was to pack bags and leave the country if the employer did not give you the letter. And you can argue that the law lets you change employer after 180 days and hence you are not breaking the law. You can also argue that if the employer had not acted in bad faith by refusing to give you employment letter, you would have continued to work for the employer.

    Ofcourse, you will need a very good lawyer if you want to fight the case on moral grounds (because it may be more expensive to fight the case than just pay the amount agreed to in the letter).

    We all morons and still wont learn, we will still start predicting for next visa bulletin hoping that a reincarnation of god will come and deliver us visa numbers.
    Unless we all make a collective effort no one is going to listen to us.     There is nothing change in the next bulletin. What you saw from the last couple of bulletins "Unavailable". That should be happened with in few months. This is my opinion. I am not blaming any body. This is the real situation going on from the last couple of years bulletins.

    I'm no senior member, but I would guess your red dot to be a feature of the software running this forum. Depending on the number of posts (50,100 etc), it changes.

    The red/green dot is based on the response from other members to a members post. (see the balance icon on the header?) If a member's post is continously rated as I disapprove, the green dot changes to a red one.

    This thread has lost direction and purpose. From a question of what will happen once lame duck session starts, it has degenerated into an "us vs them" argument which has no end. Ultimately, this thread is being closed.

    Yes, Microsoft and many other major employers could easily find qualified US students with two years of experience, skills by the way comparable to what the vast majorities of H1B's offer, but Americans who do not need the H1B would give a finger to any employer who would expect that an American would work 80h/week for 55K/year.


    Hmm, so one would conclude that immigrants work harder than the natives. What is stopping the natives from working as hard? At the very least the immigrants are keeping natives honest and increasing competitiveness.

    You also misunderstand the chief reason why younger employees work long hours. It is because they want to learn and become more productive in the future, so they can make more money, not because their job depends on it.



    The illegal aliens are being backed by major employers of cheap labor, such as Wall Mart and many others. Illegals also can put extra long hours and therefore they yield more output for less investiment. That's is the reason that US employers seem to fight so consistently to keep them here.


    This may well be true for illegals. In fact it is true for any work that is well understood.

    By its very nature high skilled workers are expected to perform leveraged work where there isn't a direct correlation between results achieved and the number of hours worked.




    For the naive and dreamers out there who are shaking their heads after reading the above and believe that employers cannot find qualified applicants, so just answer this:
    How many million dollars per year are the top management of Fortune 500 companies making? The US is not about drastic wages inequalities. This is about paying a fair salary, otherwise we have increasing salary inequality and this should be renamed then to Mexico, India or something like that.


    See my comment above about leveraged work. This applies all the way to the CEO, and is the reason for insane salaries. As for the point about salary inequality, US income equality is better than Mexico's and significantly worse than India's, so there may be something there contributing to angst amongst Americans.

    I fully support this rally...what I can do for now is to convince my friends to attend! I will also write some letters to TV and radio to cover this rally. I will also write on some blogs and invite others to attend the rally.

    Just Chill Guys,

    I am EB3, and i know we EB3 are screwed , and EB2 are luckier than us.

    There is no need to fight,

    If we dont get the GC , we can go back home(for me home is india) .... believe me home is not so bad( even after the blasts) Just enjoy your time here, live for the moment.

    I work for an employer , whom i value more than EB2 , so i dont want to port to EB2(Even when i filed for EB3 , i was eligible for EB2 , But my lawyers assistant , just wanted to play safe) Everyone has his own preferences.

    I think this is a post , for the EB3 to crib , and talk (humans feel good after doing that) so let us do that.
